On October 2, 2025, the federal government released an interim emergency rule that immediately changed how H-2A wage rates are calculated without going through the usual public comment process. The new formula for Adverse Effect Wage Rates (AEWRs) will lower the required pay for many H-2A positions, and it may invite legal challenges going forward.
